REPORT OF VIOLATION OF POLICIES OF THE EVUSA

The following policies will be enforced for all EVUSA members, Board of Directors, EVUSA Officers, employees, volunteers, and contractors who provide substantial services to EVUSA.  Enforcement may include remedial action including education/training, removal from role, suspension or termination.

POLICIES OF EVUSA: 

PROCEDURES FOR HANDLING REPORTS:

Upon receipt of the alleged violation, the Compliance Officer or Exec VP will prepare a written report outlining the violation, collecting any evidence, and including a response from the accused.  They shall handle any inquiry or report confidentially and discreetly and will not make public the name(s) of the person(s) making the report nor the accused person(s) or group(s). The Exec Vice President may consult with legal counsel, as necessary.

Within 21 days, the written report will be forwarded to the Hearing Committee. 

Within 15 days of receipt of the written report, the committee will hold a hearing, inviting both the individual alleging the violation and the accused, neither of whom are required to attend and may choose to submit written statements.  Any evidence or other testimony will be submitted in writing. The Hearing Committee will make their decision at the conclusion of the meeting and provide a written record of the decision to the accused within 5 days.

The Hearing Committee decision may be appealed to the EVUSA Board within 15 days.  This request must be made in writing to the Executive Vice President. 

The appeal must contain new evidence not available to the Hearing Committee and/or concerns regarding the procedures of the Committee. It is not a second review of the presented evidence. The accused and the Executive VP or Compliance Officer will be invited to the closed session of the EVUSA Board. The Executive VP will not have a vote on the final decision regarding the appeal. Any Board member with a Conflict of Interest will recuse themselves from any discussion and physically remove themselves from the closed session. This would include any members of the Hearing Committee.

A decision regarding the appeal of the Hearing Committee findings and any changes to the disciplinary measures will be made with a vote of ¾ of the Board members present at the closed session. A written record of the decision will be provided to the accused within 5 days of the closed session.
